Volvo Construction Equipment Rents, Inc., (“Volvo Rents”) is committed to protecting the privacy of personal information you provide to us, including through the use of this website (the “Site”).  “Personal information” is data that can be used to uniquely identify or contact a single person.  We are providing this Privacy Policy statement so that you know what information we collect from you, how we use it, and how you can contact us to request information or changes to the personal information you provide to us. Use of this Site signifies your understanding and acceptance of the terms of this Privacy Policy. When you rent equipment from or conduct business with Volvo Rents, and when you visit and use our Site, we may need to collect certain personal information from you in order to provide and improve upon our services. How we collect this information will depend on how you choose to use our services and interact with us, including the services and opportunities we might provide on this Site. We may collect personal information that you provide to us directly when you conduct business with us, including via telephone, fax, email, at the counter, upon completion of a rental form, or through your use of and interaction with us on this Site. Such personal information may include, but is not limited to, your name, home and/or business address, phone number, email address, date of birth, social security number and/or tax identification number, driver’s license information, and payment and credit card information.  We may also record information that details your purchases (e.g. where you rented equipment or purchased other products or services, payment arrangements, insurance preferences, usage, and other information related to the particular equipment you might rent or other products or services you might purchase). 

We may also collect personal information you provide while using the Site, such as information you provide during an online transaction, any online account information, e-mail addresses, and other information you might provide to us.  For example, we may require your name and e-mail address to add you to an e-mail newsletter list or enter you in an online sweepstakes or promotion. We may require a home address and telephone number to enter you in a contest or sweepstakes so that we can send prize notifications and prizes or to send you special offers. Users who register to receive information via a wireless device may be asked to submit a cell phone number to receive text messages. We may also offer the option to interact with one of our representatives directly while using the Site in order to ask questions, request information, and to assist you in using our services, and we will record the information you provide during these interactions to assist us in providing top quality services. You can access many features on the Site without providing personal information to us, but this may prevent you from making full use of all the online features and/or promotions we offer and may limit our ability to provide you with the level of service that you would otherwise expect from us.

How Volvo Rents Uses Your Personal Information

 Volvo Rents will collect and use your personal information only for specific purposes.  Volvo Rents will collect and use your personal information:

• To provide the services and offerings that you request, and to communicate with you regarding such services and offerings;

• To do all things necessary to administer those services;

• To research, develop, manage, protect and improve our Site and services;

• To maintain and develop our service-oriented software and other business systems;

• To provide you with  information on products, services, special deals, contest announcements, surveys or a newsletter in connection with a product or service about which you previously inquired, or about a product or service that we think you might be interested in;

• To notify the winners and award prizes in connection with promotions; and

Choice/Opt-out

You may opt-out of having your personal information used for commercial purposes.  Users who no longer wish to receive our promotional communications may contact us by email to be removed from our lists.  Be sure to include any contact information that you want removed from our promotional contacts list, including physical addresses, phone numbers, and e-mail addresses (If you use more than one e-mail address, send your opt-out e-mail from each of your e-mail addresses.) If you receive any online newsletter or similar promotional e-mail communication from us, you will always be given the option to “unsubscribe” from receiving further e-mail communications from us at any time.  Your option not to receive promotional and marketing material will not preclude us from corresponding with you, by e-mail or otherwise, regarding your existing or past business relationships with us (e.g., any purchase of our products or use of our services, or responses to requests for information you pose to us either through use of this Site or by other means), and will not preclude us from accessing and viewing your personal information in the course of maintaining and improving our Site and our services.

Safeguarding Your Personal Information

We will take reasonable security precautions to protect your personal information from unauthorized access, loss, misuse or alteration. Only authorized Volvo Rents representatives and agents working on Volvo Rents’ behalf have access to the data.  Volvo Rents representatives and agents will not share information with any third parties outside Volvo Rents, other than as set forth in this Privacy Policy.  If at any time you provide a third party’s personal information to us, you warrant that you have permission to do so and you agree to indemnify, defend and hold harmless Volvo Rents from and against any claim, liability, cost and expense arising in connection with your provision of that information. 

For purposes of forums, discussion boards, certain promotions, and other public interactive areas that may be available on our Site from time to time, you are solely responsible for the information and other content you post on or through our Site.  You understand that personal and other information that you post on or through public areas of our Site are generally accessible to, and may be collected and used by, others and may result in unsolicited messages or other contact from others.  Users of our Site are encouraged to exercise caution when posting personal information about themselves in public areas. 

What We Provide to Others

We also may disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating the terms of use of our Site.

Some Volvo Rents locations are owned and operated by an independent franchisee or licensee that  is neither owned nor controlled by Volvo Construction Equipment Rents, Inc.  Each such franchisee or licensee may collect and use personal information for its own purposes.  Volvo Rents does not control the use of or access to such information by these franchisees or  licensees or their associates. This policy does not apply to a licensee's or franchisee’s web site or the information that they may otherwise collect when providing you certain services. Independent franchisees or licensees may also use email campaigns and other methods of telephone, electronic, and direct mail solicitation without our consent or knowledge, and are solely responsible for their content and methods of identifying and contacting addressees.

Our Site contains links to other sites. We are not endorsing any such linked websites and we are not responsible for the privacy practices or the content of such linked websites. Any links to outside sites are provided solely as a convenience to our visitors.  You will need to make your own independent judgment regarding your interaction with these links.

Children

This Site is not intended for use by children under the age of 13, and Volvo Rents does not knowingly collect personal information from children under the age of 13. If we learn that we have collected the personal information of a child under 13 we will take steps to delete the information as soon as possible.

Notification of Changes

We reserve the right to change or replace this Privacy Policy at our sole discretion at any time. In the event our Privacy Policy should materially change, we will generally notify our users by posting a notice of such change in a separate section of this Privacy Policy so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.  Users will have the opportunity to opt-out of any change in the use of their information.  However, if users have opted out of all communication with the Site, then they will not be contacted, nor will their personal information be used or disclosed in this new manner.  Your continued use of our Site following the posting of changes to our Privacy Policy means you accept those changes.
